There is nothing to contract for yet: TOVIA has no accounts, no billing and no self-serve signup. These terms are required before the first account, not before the first visitor.
Three things are already decided and will be in them: the service is B2B only, with an affirmative professional-capacity declaration and a VAT ID; the liability cap carries the mandatory carve-outs Spanish law requires, because a waiver of liability for dolo is void under Art. 1102 of the Civil Code; and the switching terms meet the EU Data Act — a notice period of no more than two months and a transition window of at least thirty days, with a machine-readable export you run yourself.
